RE: MLT Patched UP license needed?

If it were me, I wouldn't worry about it, but then again, that's just me. I KNOW there are many UP items in the file library already who were made by those who don't have a license, so I don't know how big of a deal it would be. I'm sure some othere would gladly voice their opinions/knowledge here.

RE: MLT Patched UP license needed?

Kevin That's because no one has turned you in, yet!The correct answer, no matter what the anarchists say, is yes you do...It's a PITA but since you are freeware all you have to do is fill out the form and fax it in.... UP apparently gives those out very freely... They also will give you access to the official style and color sheets.... So that alone is worth it....The short answer is yes you should.....Chuck Schneider

I have heard about people caught selling/distributing UP stuff all that UP did to them was to ask them to get a License Agreement. If they don't UP will probably press a law suit against them. The only lawsuits so far I seen UP do is against Athrean and Lionel, and I heard UP gave them the opportunity to get a license before they had a lawsuit against them.

Why spend all the time putting your efforts into repainting a model to not finish the job. Getting permission is part of the job, regardless of whether it is UP or one of the developers here at t-s.com. Take the time, get the license.

Robert Hundman had a very interesting editorial about this topic in the Sept '04 issue of Mainline Modeler. He raises some interesting points, and gives some insight to this process that few have mentioned here. Quoting from the article:"The Union Pacific contract, should anyone be foolish enough to sign it without the advice of attorney, carries a clause that affects the continuation of the contract, which for some is set at one year, and for some at two. The clause says that sixty days prior to the renewal date, the Union Pacific may withdraw from the contract. At that time, tooling for any UP related product then belongs to the Union Pacific, and existing inventory must be immediately disposed of."According to the article, the lawsuit that involved Athearn and Lionel ONLY included the "Building America" modern scheme/trademark.Further, the article goes on to state this:"The Union Pacific has thus far refused to enter litigation on fallen flags..."Likely for good reason, in regards to the current ruling by the trademark courts, which, I understand, is being appealed by the Union Pacific. When finally made aware of the situation that exists between the Union Pacific as a railroad, and the Union Pacific's attorney department, Chief Operating officer James Young was quoted as saying: "anything we wold gain does not even amount to a rounding error on the bottom line." Again the article has this to say about Mr. Young's observation: "that the cost of collecting this fee exceeds the income"Bottom line: Could be that eventually the powers that be within railroads will figure out that spending the major dollars to go to court to sue some small peanuts operation (in comparison to the Union Pacific) is absurb and counter-productive.It will be interesting to see how all this plays out.Edit: TyposAndre MingVisit VSC's temporary web page at: http://www.vscalecreations.comVisit VSC's Forum at: http://www.3DTrains.comMLT Patched UP license needed? – image 4

That may be the case Andre that UP and others change their policy....
However until they do it comes down to the difference between Right and Wrong or Will I get caught or Can I get away with it?????In other words are you a moral person with a clear sense of right and wrong or are you a spoiled brat with situational ethics who needs a trip to the woodshed?????? Or alternatively are you just some slug low life intellectual property thief with absolutely no business ethics willing to sell turns on your momma for about $1.398???????(Not you Andre but the ones who advocate ignoring the clearly expressed and legal wishes of the Copyright owner! You will note that the gentleman who you quote is a creature of the same model building companies that got themselves sued.... And FWIW their attorneys probably picked the cases easiest, and cheapest, to win....) I for one am sick and tired of the bomb throwers coming on here and other fora who encourage others to challenge UP and the other railroads as a matter of Principle... The key here is they encourage others to do it with out risking anything themselves....
Let's see how tough they are when it is their house and car at risk in a law suit.... Not just mom and dad's! Well we all pretty much no the answer to that one don't we? So why are we still having these slugs' opinions parroted on here????? I'd strongly encourage the writer in Mainline Modeler to put his house and car and bank account where his mouth is... Otherwise I'd encourage him to Siddown and STFU! Instead of encouraging others to risk THEIRS!Right or wrong Athearn and Lionel did and lost! Precedent is now set!IMHO it is a question of Alligator mouths writing checks their humming bird butts do not have the intestinal fortitude to cash! I have no respect for people like that and you guys shouldn't either....Chuck Schneider

RE: MLT Patched UP license needed?

As for my take on all of this mess and how it relates to me personally: The item I'm most interested in is the final outcome of the Fallen Flags. Personally, I don't particularly care to model anything UP. (An aside: I did find it interesting that the only litigation involved the "Building America" scheme and UP did not go after the whole enchilada.) The Fallen Flags are another matter to me, though. I have several of those that I could find interest in modeling. (The MOP and Katy, for example.) Currently, I'm at a loss to see through the fog to see which ones are currently being ruled upon, etc. (i.e fog = UP's legal claims as opposed to the trademark ruling that's pending appeal.)At this point, I have chosen to avoid any/all railroads that are associated with UP, as I want no involvement with UP. I intend to remain on the sidelines and wait until this is settled legally before I know how to proceed, or even if I proceed. Otherwise, if one wants to play with trademarks that UP claims they own, then the modeler needs to abide by the current rulings.
