Jan-23-02, 06:53 PM (EST) "Attention all add-on makers" One of the reasons why it's been so hard to log in to the train-sim.com file library lately has been Marco Martini (martini@galactica.it) of mstrain.org in Italy. He has been leeching files from Nels' site, just linking to the files from his own website. Whenever new files have been uploaded to train-sim.com Marco has added links directly to the files from his own web site in order to generate traffic so that he can make money off his web banners. And it's Marco's fault that you can't right click on the download links anymore. And now Marco has started to simply copy all files that are being uploaded to train-sim.com, for download from his own site, without asking anyone's permission...So I suggest that all the people who have uploaded files to train-sim.com lately contact the leeching low-life Marco Martini by email (martini@galactica.it) and demand that he remove their files from his web site. If he refuses simply tell him that you'll contact his Internet service provider, Aruba.it (technical@technorail.com), and demand they'll close him down because of breach of copyright.IMO he ought to pay for making it hard for the rest of us to download files from train-sim.com.... Jan-23-02, 07:46 PM (EST) 1. "RE: Attention all add-on makers" Hello Svante: Most of us do not even know who this Marco Martini person is. If he is doing what you say I will agree with you. But before anything is done should we not at least be provide with some information? Besides this should be handled by Train-sim and not by those who enjoy this site, If Nels knows about this let him post a reply about this. It is really not what we should be getting involved in. I agree that something should be done, but let those who have the responsibilty and the know how handle it. I have been wondering why I couldn't get into the library and this explains it. It makes us all mad but please do not stir up a hornets nest. I don't even know what Nels last name is, I don't even know what your name is but if your one and the same please except my apologies. The Trains must roll on.. Thank You, CHUG-ON

Jan-24-02, 04:38 AM (EST) 4. "RE: Attention all add-on makers" Hi all,
Svante is correct and Marco has been downloading the files and
placing them on his website...My files are there and I have
specifically requested in the readme.txt file that the files
only be made available thru www.train-sim.com but Marco seems
to either not have read the readme or is ignoring it..
Either way he is violating the request I have made and I have
sent an e-mail to him and his ISP suggesting that the files
be removed or I will ask the ISP for help in remedying the
copyright problem. I suggest that anyone who has a file they
want protected from this type of infringment do the same.LaterControll Remove | Alert Edit | Reply | Reply With Quote | Top

Jan-24-02, 07:09 AM (EST) 6. "RE: Attention all add-on makers" "i was a bit surprised to see his download section too, its like a mirror of this site"It is a mirror of this site. He simply copies everything that is uploaded to train-sim.com. Before Nels stopped his leeching a day or two ago he simply linked to the files at train-sim.com stealing bandwidth from Nels. So Marco Martini got paid by Amazon and others for the banners at his site while Nels had to pay for the bandwidth. So Marco Martini is nothing but a simple thief. "RE: Attention all add-on makers" simple thief is putting mildy, he is a BIG FAT FRAUD! im sure if amazon, com knew what he was doing, he would be terminated from the amazon associates so fast he wouldnt know what hit him. im an amazon.com associate too, but im honest, i dont leach stuff from other sites in order to get hits. i havent made a cent from it yet either, but who knows i may get lucky one of these days.

Jan-24-02, 11:03 PM (EST) 11. "RE: Attention all add-on makers" Hi all,One thing we don't want to do is seem like a bunch of ...
these are ours and you can't have 'em....kinda folks...
I want anyone who wants my files to have them..however,
I do expect them to get them from the source I have specified
in my text files...If they do this then anyone who wants my
files are welcome to them.....And Nels has done such a great job on this and the FS site that
I believe a contribution for the ability to download files with
no waiting and loggin-in is little to ask for all he has made
available to the simming community.Anyone who doesn't respect the artists wishes and blatently
ingores a plea from the same deserves all the online community
is able to bring to bear on this individual....LaterControll Remove | Alert Edit | Reply | Reply With Quote | Top

Jan-25-02, 00:27 AM (EST) 13. "RE: Attention all add-on makers" I agree. I did not ask or allow posting on his website or I would have posted my work there. MSTrains.org has updated their website with a 'copyright notice' on the home page:COPYRIGHT STATEMENT Regarding the defamatory action versus www.mstrain.org initiated on a MSTS Forum hosted by other website, We precise as follow:All add-ons presents in Our File Library can be downloaded for free as freeware, as the add-on has been released from the respective Authors. An add-on released as freware can be distributed liberally if this activity is without charge. In fact the only publisher obligation, for freeware software, is to respect the integrity of the files and do not sell it. All files are pubished by www.mstrain in according with the copyright statement contained in each file. Also, all material and mstrain.org links are resident and/or point directly to Our Server.

To offer this service for free to MSTS Comunity Mstrain.org pay a much of $$ for disk space, storage, trasmission band etc., and we ask no contribution to nobody. Probably, this free activity opposes with the economic interests of other website.......(!)MSTrain.org is and will be forever a website totally FREE. We will continue to collect the best add-on for MSTrain Simulator and offer they to MSTrain Simulator Enthusiast totally FREE. Marco Martini
I guess he thinks freeware means may be redistributed in any form without expressed permission of the author. db

Jan-24-02, 11:26 PM (EST) 12. "RE: Attention all add-on makers" I think Nels has fixed the problem. If you try and right click on any of the internal pages (the ones past where you log in), a box pops up that says- "Sorry Marco, but right click is not allowed." I found this in the new files area when I accidentally right clicked.-Chris Trott

Jan-26-02, 03:17 PM (EST) 15. "RE: Attention all add-on makers" LAST EDITED ON Jan-26-02 AT 03:20 PM (EST)Well another turn in the continuing saga of Mr Martini. Going to his website today and clicking on downloads you now get this message:Downloads Important NoticeOur File Library System is under major upgrade. We apologize for this inconveninece. Please, go back laterThanks for your patience. I hope this means he is cleaning up his act, and removing those files from those of us who requested personally to have them removed from his server. I for one don't mind what you do to my files after you download them, since the only thing I can really say was mine was the repainted ace files and not the model, or the eng files, etc. I'm thinking of the real creator of these files. I would like to continue to repaint, and not have the originator back down because of this. That would hurt everyone! What I would really like to see, Mr Martini, if you to are reading this- is for you to remove EVERY file from you website and start over in a Clean, Legal, Decent Fashion, and simply create a 'POST FILES HERE' section for people who would LIKE to post their files on your website. You're legal, you aren't violating anyone's copyrights, AND, you give Train-Sim.com some competition at the same time, if you have posted files that aren't posted here!
Consider that!db

Jan-26-02, 07:00 PM (EST) 17. "RE: Attention all add-on makers" Hi All,I have recieved an e-mail from Marco telling me that he is
removing my files from his website as of today due to the
readme.txt file stating that they should only be downloaded
from www.train-sim.com...hence I believe that he is trying
to get in the spirit of the sim community and he should be
given a second chance...I know some of you may think otherwise
but this community shouln't harbor I'll feelings about someone
for the fledgling problems they might get into in starting a website to furthur our endeavours....I have sent him a message
stating that if he wants to place pics of my work on his site
and then have the download link point to Nels front page I didn't think this would be a problem for anyone...so he may be
taking the time to do this. If anyone has issues with him over
the use of their files on his site I would suggest contacting
him directly thru the e-mail link above or on the website he
has to inform him of the issue and see if you can get resolution.I feel he has done good by me and I will welcome him now into the sim community.LaterControll Remove | Alert Edit | Reply | Reply With Quote | Top
