RE: WV&O GE's

WEll if they/TA took them off-line and now they are payware then anyone publishing them on the web is violating copyright law.... however I thought they were in the library at TA's site or maybe still in the Club TA site.... (gotta buy something to get in there)Chuck Schneider

This is copied directly from the EULA included in the pack from Trainartisan:You may freely distribute this software in its full
unaltered archived format provided that you do not
receive any financial gain from said distribution or
use. If distribution is part of a larger commercial
effort, written permission must be provided by
Cyrus Lum (acylum@trainartisan.com) before distribution
can take place. It would seem that anyone can send, post, or distribute this to anyone at anytime as long as you don't make money...RobPS (EDIT) The following is also included:4.You understand that the Train Artisan CWAC60
Add-on is a copyright work of Train Artisan
and the add-on, in whole or in part, may not be used
or included in anything else without the written
permission of Cyrus Lum
acylum@trainartisan.comIn other words, it's OK to distribute the entire unaltered package, but not to package it seperately or with any repaints. You could however, distribute the package, and then distribute the repainted textures for use with the package seperately.

RE: WV&O GE's

>WEll if they/TA took them off-line and now they are payware I don't think you can alter a copyright after release, that would be an Ex Post Facto, or "After the Fact" alteration, and would assume knowledge on the part of the user that something in the EULA had changed. I'm not a lawyer, nor do I play one on TV, but I don't believe e-mailing a copy of the train pack or even posting it on Train-sim would in anyway violate the copyright as long as no changes had been made to the original file. In other words, IF TA released a 2.0 version with changes, distributing the 1.0 version would be legal, and the 2.0 version would be governed by the EULA included in it. That's why MS can distribute free copies of it's OS's (Release Candidates) and then charge for a Final Release. I understand everyone wants to be legal, myself included, since I have models in the File Library. Unfortunately, as we have seen in both the Flight-sim and Train-sim community, petty squabbling can hurt everyone, so if TrainArtisan did not wish me to e-mail copies to anyone who wanted one, I would cease and desist out of respect for my fellow train-simmers. In other words, let's R-E-S-P-E-C-T each other: Is it OK for me to e-mail this to other individuals, TrainArtisan?Rob

RE: WV&O GE's

So theoretically, it would be alright for someone to send a copy of the file, or would it be easier for someone with the file to ast TrainArtisan if they can u/l an unmodified original version ?NZ
