In Railpace Newsmagazine's May issue, there's another one of those Darwin Awards.BTW, bold is my comments"Darwin Awards: Two teenagers who were severely burned when they came in contact with the cantenary while on top of a rail car Duh! thats like saying 'its hot in an oven' in Lancaster, PA are suing NS and Amtrak for damages in excess of $150,000. The incident happened on August 10, 2002. A skateboard was found on top of the car. Their attorney claims the accident could have been prevented if (get this) there had been signs warning the teenagers of the electricy surging through the wires (and to not skatboard on top of rail cars"I'll let you guys take over from here-Dave

The suit reinforces their unintentional assertion of ignorance and the attorney’s desire to make a buck. Ridiculous, what a waste of the court’s time. Crazyness – image 5

Here in the NY metro area,a guy is suing because he broke his leg sliding into home plate during an amateur baseball game. He's suing the player he collided with and the town it occurred in.

>game. He's suing the player he collided with and the town it
>occurred in. Well without knowing the full facts of the case something like
that would simply not stand up in court ('simply not cricket, sir') over here unless there was a provable delibrate act on the part of the opposing team.
There seems to be a greater understanding of 'sporting' injury
here in the UK, although with the current Accidents Direct design
of personal injury specialists it won't be long before possibly frivolous lawsuits get into the courts here As to OHLE, The way I understood it was that the view taken here
in the UK at least professionaly was that all exposed 'conductors'
and associated equipment were assumed LIVE unless confirmed otherwise.
It seems this view is widley held by the public and that it is a minority that don't, however stupid.I don't see why normal people would sue a railroad for something
that is the result of thier own delibrate dangerous behaviour. An individual suing because a they slipped on an uneven of sliipery platform whilst waiting for a train is a different matter..I suppose the real issue is how one defines a 'duty of care' to
passangers and third parties.Alex

Teen 1: You know what? Skateboarding on the ground isn't very fun...Teen 2: You're right! Let's go skateboard on the roof of that boxcar!Teen 1: Cool! And we can swing up onto that wire and grind on it!Teen 2: OK! You go first! Say, what's that buzzing sound coming from the wire?Teen 1: Must be vibrating! Here I go! BZZZZZZZZZZZZZZZZT! AAAAAAAAAAAAAAAAAAAAAhhh!!!!!!!!!Teen 2: LET'S SUE!A likely conversation between the two before and during the incident... Joe LeMay

RE: Crazyness

Wires or no wire, skateboarding on a rail car is pretty dangerous to start with. Actually considering that the metal body of a rail car is pretty much earth ground it is surprising the little darlings weren't killed when they completed that circuit. I hope NS is clever enough to fight this suit to the last appeal to discourage lawyers from filing these suits. A jury of reasonable adults would most likely find for the railroad a case such as this. Contingency lawyers get nothing if they lose the case not even their expenses. NS should file trespassing charges against the little urchins as well.Be Seeing you.

What kind of dumba$$ zaps themselves with the catenary and then sues the railroad as if it was their fault that they had nothing better to do but tresspass and nearly kill themselves?

To ALL: This happens all the time; The RR that I worked for had a lawsuit filed against them and me when a person ran there car into the front step of my engine, at a road crossing. I don't know if the Company settled, which they do most of the time, because it cost to much to fight these suits.cond mike
