One of my favorite web sites is under attack – image 1

The California Coastal Records Project (http://www.californiacoastline.org)The project is intended to create a permanent record of the California coastline. The Adelmans do not profit from the web site. Their single goal is to advance the cause of coastal protection by enabling the public to access "truth in pictures." It is a great site for railfans. With 12,000 beautiful high resolution aerial images of the California Coast line. Much of the Surf Line, the SP coast line, and portions of the California Western are included. I got permission from the site owners to include links to a number of images of interest to railfans:http://www.railwaystation.com/airsw.html#CAUnfortunately, although the pictures were taken from public property (over the Pacific Ocean), a number a residents who have property along the coast, object to the display of these images on the web. One rather famous property owner, Barbra Streisand, is suing the web site's owners and their ISP for invasion of privacy and violation of California's "anti paparazzi" statute.Fortunately, the web site's owner seems to have deep enough pockets to fight off legal intimidation, and is quite eloquent in defense of his project:http://www.californiacoastline.org/streisand/pressrelease-lawsuit.htmlThis goes beyond a single photograph. If this house can't be photographed, then any individual could object to publication of photographs that happen to include their property. Consider the the picture of the Transit Center in Oceanside - scores of residences are also visible. The situation is painfully familiar to railfans and other photographers who are encountering attempts by to restrict photography and use of photographs, even when taken from public property.Ron

It is one thing to take a photograph and quite another to publish it. You generally can photograph anything you can see from public property. However, in many cases, to publish a picture you have taken, you may need at a minimum verbal permission and possibly a document known as a property release. This is a document signed by the property owner authorizing the photographer to use the photo publicly (e.g. publish it). This is very similar to a model release which is required when photographing professional models.Obviously, if you are on the property in question, then you need permission just to take the photograph. You will still need permission or a property release to publish the photo. The city of Portland, OR is proud to have a beautiful classical Chinese Garden which was completed about two years ago. If you are carrying a tripod, you have to have written permission just to take your camera and tripod into the garden. If you intend to publicly display or publish any photos taken inside the garden, you must provide a print of each photo you plan to exhibit or publish and get written permission for each.Bottom line, be careful where you point that lens, and be even more careful what you do with the pictures you take. Incidentally, posting a picture in a forum like this is no different than putting the picture on your private website. It is still a public exhibition of the photo and all copyright laws and release requirements still apply.Happy shooting (photo) and keep 'em on the track.

Take a look at almost any published railfan photograph. Most are taken from public property and almost all include private property (the railroad) as the subject or in the background (houses, buildings, etc). If property owners are allowed to block publication of images taken from public property, magazines and newspapers would become mostly "text only".Consider the case of a corporation or individual which was violating pollution, safety or zoning laws. I'm sure the PR department would love to prevent publication of photographs revealing their activities. Indeed, this seems to be the motivation behind some of the attacks on the CA Coastal Project. > Thank goodness we have the 1st Amendment. Well said that man.At least in the US you can still technically take pictures
of railroad locations. Here in the UK you can't as Network Rail's PR
dept went into paranoia overload recently and
labelled (quite unjustly) rail-fans and 'unoffical'
photogrpahers as a 'security-threat'.Apparently people collecting details about train
movments are also a 'threat' as the information
is alleged to be of use to 'terror' groups. It's already illegal to publish 'anything' that relates
to or features 'nuclear-waste' trains or millatry
rail activities.(Which in the latter case is probably
understandable.)One rail-fan on the Transport Forums site has jokingly
suggested that St Pancras outght to be renamed Airstrip One!<1>
in response to comments about the attitude of 'security' at
that location.Alex

I don't know why she wasted her time to complain about a few photos taken of her "mansion" and sue those whom have the interest in taking pictures along the coastline. No one would've known whose house it is or who lives there until she complained. How dumb is that?

To be a bit fair, the web site identifies the house and shows up from a search. But I'm sure the publicity from the suit has brought much more attention to the house than there would have been otherwise. Before, it was just one of 12,000 images.Ron

Funny how that works...if she's left well enough alone I (and probably many others) would have gone on not knowing (or caring) that streisand lived in the state of California, never mind where exactly she lived. Now I know where to get pics of her house. There was a similar story on Slashdot last week about a former miss Vermont who was sueing a former boyfriend for posting details of their relationship in a vain attempt to preserve her "reputation" because he basically said she was a boozy slut and she's currently trying to head some sort of youth abstinence movement. I say vain attempt because now I know her name and rep whereas if she'd refrained from litigation I'd never have known either. Way to "protect" that reputation! You cannot hide intimate details about yourself from the public eye by litigating.Anyway, I hope streisand loses. I didn't really care for her music before this but now after this stupidity I will go out of my way to make sure she doesn't get one thin dime out of me.
