Just a glimpse into the Real World, Oz style. A tourist route that has run for 28 years without an insurance claim, just had it's premiums increased 500% to A$96,000 ! It closed down last night. If you want a glimpse of it, go to www.prr.org.au
It's a crying shame, and it's happening in lots of other areas also, in Queensland, Doctors are threatening to go on strike over public liability increases. It's affecting all areas of the community, but when it hits the railways, tourist or otherwise, it's time to get mad !!
regards
grandpa

RE: Public Liability

Yeah its really starting to affect all aspects of the community such as Redcliffe council removing playground equipment from parks. The Pichi Richi Railway is one of many tourist railways that are being affected by these unreasonable hikes in their insurance premiums. Some Tasmanian tourist railways such as the Don River Railway are in the same situation as PRR and face closure. It seems that many peoples lack of personal responsibility in society combined with the large payouts from litigation has caught up with us. I hope this situation can be resolved.

RE: Public Liability

Its the same up here in Vancouver,BC
The Royal Hudson won't be running because of insurance premiums going up over $100,000.We can thank those b*st*rds who flew those jets into WTC for all this liability stuff.I've bee on the Royal Hudson a few times...its a very nice trip like going back in a time warp when steam ruled the rails.Hopefully things can get worked out and these trains will run again.

RE: Public Liability

No
You can thank greedy bloody lawyers and some (many) individuals that file false accident claims. We had one idiot here (Australia) dive into shallow water at a beach and break his neck as such the local council had to pay millions in compensation, stupidity should not be rewarded idiots should be made to pay for there own mistakes. Our Government needs to cap these claims and stop Idiots, Lawyers and Insurance companys from making an easy buck.Peter

RE: Public Liability

Have you guys been stealing our lawyers? If so, please, don't stop! We still have a bunch left. But, seriously, this is a problem. We used to have the FREEDOM of viewing an operating steam special. That FREEDOM is being taken away, not by terrorists, but lawyers. We may have discovered the "enemy within". Who's side are they on? Politically I would most likely be categorized as "conservitive with libertarian leanings". I do believe in capatalism but, when it begins affecting society in a negative way, it's time to place some limits. Unfortunately, our Halls of Congress are populated almost entirely with lawyers. I myself will never again vote for ANY candidate with ANY kind of degree from ANY law school. This country ran a whole lot better when it was run by farmers and merchants. Thats just me, venting my $0.02 worth.Jeff

RE: Public Liability

These alot of that going on.....false claims that is.
Here in the Vancouver area we have people staging accidents and I'm sure its happening where you live.We have kids that play or walk on railraod tracks then get hit by a train and the family sues the railroad for the kids stupidity. There are thousands of ways to make a false claim to get that quick buck and guess who pays for it...........us of course the honest people.Sept 11th has also chaged the way insurance companies do business with owners of skyscapers, landmarks, rsilraods and anywhere there would be alot of people.
They now see these structures as a liability trap.I'm sure after Oklahoma City insurance companies saw government buildings in a different light.Back to railroading and the shutting down of the few remaining steam locomotives. What are thses people afraid of?Terrorist attack? someone jumping off the train? someone jumping in front of the train?
track failure? equipment failure? sabatoge? If people let their fears rule them then they'd stay in the house.ok enough ramblin

RE: Public Liability

G'day grandpaOz,
from another Aussie Grandpa, I heard yesterday that the Pichi Richi was being closed down.Yes, its a darn shocking thing that lawyers here have picked up on sueing for the slightest thing for huge bucks, as the bigger the payout the more they rip off, reason for the huge payouts. It's disgusting to think that it has got this way, that as soon as anyone trips over, he or she has now already figured out just how much it is worth to sue for before they hit the ground. Sick, mate sick.Years back we all accepted responsibility for own actions, no matter what we did, sueing was virtually unheard off, but sad to say it's a sign of the times. These days no one accepts responsibility for what they do, everything has a huge $$$$ price on it. Being grandpa's we have lived long enough to see the deterioration of these attitudes in this country, and the world overall. Everything these days has a big price, and yes sad to say, we ALL are paying for it, one way, OR, another. Cause and effect in action. Without getting too much on the soapbox, we are all just reaping what we have sowed overall, but the magistrates really do need to stop these absolutely unreal lump sum payouts and any payments won perhaps made on the drip. Even give these fancy so called lawyers who win these cases their fees on the drip as well. It's hard to know what the answer to all this is now, as once you open and take the lid off Pandora's box, it's impossible to get the lid back on. Well that's my 10 cents worth.Public Liability – image 7

RE: Public Liability

According to media reports over the weekend, in Tasmania both the Don River Railway and Derwent Valley Railways have shut down completely, and all mainline trips operated by the Tasmanian Transport Museum/Classic Rail Tours, and the Burnie Council have been cancelled until further notice. The press report went onto say that the quote for the Don River Railway was $125,000 for full operation, or $60,000 if they were restricted to their private line. They closed the doors to the public at 4:00 pm Sunday. In Victoria, I'm told the 100 year old Puffing Billy line came within days of closure until negotiation created a temporary reprieve. Castlemaine-Maldon and Bellarine Penisula continue for now. Mainline tours are affected with a steam tour to Yarrawonga for 6 July by Seymour Rail Heritage Centre cancelled due to the inability to obtain insurance. It is unlikely that we will see the 50 mainline steam runs of previous years in 2002 in Victoria as the ever increasing costs of insurance push ticket prices into the stratosphere. An independent MP today called for Parliament to be recalled to discuss the insurance crisis affecting many tourist operators and rural and regional businesses as the State Government announced a temporary insurance rescue package for adventure tourism businesses: one hopes this will extend across museum and volunteer organisations (as an example many pony clubs have ceased functioning). In terms of the worldwide liability insurance scene, one has to wonder what the effects of the collapse of Enron and Worldcom will have on the insurance industry as a whole already reeling from massive personal damages payouts and the Sept 11 disaster.Yuri.
